1. INTRODUCTION & ACCEPTANCE OF TERMS

Welcome to Kampster, an AI-powered Learning Management System. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Kampster Pte. Ltd. ("Kampster," "we," "us," or "our") governing your access to and use of the Kampster platform, including all content, features, and services offered through our website at https://kampster.com and related applications (collectively, the "Service").

By accessing, registering for, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time in accordance with Section 15 below. Your continued use of the Service after any modifications indicates your acceptance of the updated Terms.

3.1 Age Requirements

3.2 Capacity

You represent and warrant that you have the legal capacity to enter into these Terms and that you are not prohibited from using the Service under applicable laws.

3.3 Account Eligibility

You may create only one account, and your account cannot be transferred to another person. If we discover or have reason to believe that you have created multiple accounts or transferred your account, we reserve the right to immediately terminate all associated accounts without notice.

4. SERVICE DESCRIPTION

4.1 AI-Powered Learning Management System

Kampster is a business-to-consumer (B2C) Learning Management System powered by artificial intelligence technology. The Service provides educational content, interactive learning experiences, AI-tutoring services, and skill assessments designed to facilitate self-paced learning.

4.2 AI-Generated Content and Tutoring

All content, tutoring, feedback, and learning materials provided through the Service are generated by artificial intelligence systems and are fully owned by Kampster. You understand and acknowledge that:

  • You will primarily interact with automated AI tutors, not human instructors
  • Content and responses are algorithmically generated based on various inputs and data
  • The Service utilizes machine learning technologies that may evolve and change over time
  • The quality and nature of AI-generated content may vary significantly

4.3 Educational Purpose Requirement

MANDATORY EDUCATIONAL USE: The Service is intended EXCLUSIVELY for educational and informational purposes. You agree to use the Service only for legitimate educational activities including but not limited to:

  • Learning new skills and knowledge
  • Completing educational assessments and skill tests
  • Participating in online courses
  • Educational research and study

PROHIBITED NON-EDUCATIONAL USE: Any use of the Service for non-educational purposes, commercial exploitation, or any form of system abuse is strictly prohibited and may result in immediate account termination.

5. COMPREHENSIVE AI CONTENT DISCLAIMER & LIMITATION OF LIABILITY

5.1 NO GUARANTEE OF ACCURACY OR RESULTS

CRITICAL WARNING: Kampster makes NO representations, warranties, or guarantees regarding:

  • The accuracy, completeness, reliability, or correctness of ANY AI-generated content
  • The outcomes or results you may achieve by using the Service
  • The suitability of AI-generated content for your specific educational needs
  • The compliance of AI-generated content with any educational standards or curricula

AI-generated responses, content, assessments, and tutoring DO NOT guarantee academic success, knowledge retention, skill development, or any educational outcomes. Results may vary significantly based on individual effort, time invested, prior knowledge, and numerous other factors outside our control.

5.2 AI SYSTEM LIMITATIONS AND RISKS

You acknowledge and understand that:

  • AI systems have inherent limitations and WILL occasionally provide incorrect, incomplete, misleading, outdated, or completely false information
  • AI-generated content may contain factual errors, biased information, or inappropriate suggestions
  • AI systems may generate content that appears authoritative but is fundamentally incorrect
  • The Service's AI capabilities are continually evolving and may change unpredictably
  • AI-generated content may not align with your specific learning style, background, cultural context, or educational requirements

5.3 USER RESPONSIBILITY FOR VERIFICATION

MANDATORY USER VERIFICATION: You agree to:

  • Critically assess and independently verify ALL information, recommendations, explanations, or content provided by Kampster's AI systems
  • NOT rely solely on AI-generated content for academic assignments, professional work, examinations, or any context where accuracy is essential
  • Consult qualified human experts, instructors, or authoritative sources to verify important information
  • Take full responsibility for any consequences resulting from your reliance on AI-generated content

5.4 NO PROFESSIONAL ADVICE

EXPLICIT DISCLAIMER: Content provided through the Service should NEVER be construed as professional, medical, legal, financial, career, or other expert advice. You must consult qualified professionals for advice tailored to your specific circumstances.

6. PROCTORING AND MONITORING DURING TESTS

6.1 Comprehensive Monitoring

When you participate in skill tests or proctored assessments, our Service will monitor and record:

  • Visual monitoring: Real-time photographs and video recordings of you
  • Audio monitoring: Continuous audio recording of your environment
  • Behavioral tracking: Mouse movements, keyboard inputs, keystroke patterns
  • Biometric analysis: Facial recognition, eye movement tracking, behavioral pattern analysis
  • Screen monitoring: Screenshots and screen recording of your activities
  • Environmental scanning: Detection of other people, unauthorized materials, or suspicious activities

6.2 Consent and Notification

  • You must provide explicit consent before each proctored test
  • You will be clearly notified when monitoring is active
  • Failure to consent will prevent you from taking proctored assessments
  • All monitoring data is stored securely for one year to maintain test integrity

6.3 Test Integrity Enforcement

We use advanced AI systems to analyze your behavior during tests to detect:

  • Unauthorized assistance or collaboration
  • Use of prohibited materials or devices
  • Attempts to circumvent proctoring measures
  • Suspicious behavioral patterns or irregularities

7. INTELLECTUAL PROPERTY RIGHTS

7.1 Kampster Ownership

All aspects of the Service, including but not limited to the software, algorithms, AI systems, interface design, website, logo, trademarks, course content, AI-generated material, educational resources, proctoring technology, and any other content provided through the Service are the exclusive property of Kampster or its licensors and are protected by copyright, trademark, patent, and other intellectual property laws.

7.2 Limited License to Users

Subject to these Terms and your subscription status, Kampster grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial educational purposes only.

7.3 Strict Restrictions on Use

You may not:

  • Copy, modify, distribute, sell, or lease any part of the Service or AI-generated content
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Remove any copyright, trademark, or other proprietary notices
  • Create derivative works based on any aspect of the Service
  • Use the Service or its content for any commercial purpose
  • Redistribute, republish, or transmit any content from the Service
  • Download, save, or copy substantial portions of content beyond what is reasonably necessary for personal educational use
  • Transfer your account or access credentials to any other person
  • Attempt to circumvent or disable any security features or access controls
  • Use automated tools, bots, or scripts to access or interact with the Service

7.4 User-Generated Content

If the Service allows you to upload, submit, store, send, or receive content ("User Content"), you retain any intellectual property rights that you hold in your User Content. By submitting User Content to the Service, you grant Kampster a worldwide, royalty-free, non-exclusive license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display, and distribute your User Content for the limited purpose of operating, promoting, and improving the Service.

If you provide suggestions, ideas, or feedback about the Service ("Feedback"), you agree that Kampster may use such Feedback without restriction or compensation to you.

8. PROHIBITED USE & IMMEDIATE TERMINATION RIGHTS

8.1 General Prohibitions

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Engage in any activity that interferes with or disrupts the Service
  • Access or attempt to access the Service by any means other than the interface provided by Kampster
  • Circumvent any access or use restrictions put in place by Kampster
  • Upload, transmit, or distribute viruses, malware, or other malicious code
  • Harvest or collect information about other users without their consent
  • Impersonate any person or entity or misrepresent your affiliation
  • Engage in any fraudulent activity or deceptive practices

8.2 AI System Abuse - IMMEDIATE TERMINATION

ZERO TOLERANCE POLICY: The following actions will result in IMMEDIATE account termination WITHOUT WARNING:

  • Attempting to manipulate, exploit, or abuse our AI systems
  • Trying to generate harmful, offensive, inappropriate, illegal, or malicious content
  • Probing, scanning, or testing vulnerabilities in our AI systems
  • Attempting to circumvent AI safety measures or content filters
  • Using the Service to harass, threaten, or abuse our AI agents or systems
  • Submitting content designed to provoke inappropriate responses from our AI
  • Training your own AI models using content or outputs from our Service
  • Using automated systems or software to extract data from the Service (scraping)
  • Attempting to reverse engineer our AI models or algorithms
  • Repeatedly submitting identical or substantially similar queries to generate large volumes of content
  • Any behavior that we determine, in our sole discretion, constitutes abuse of our AI systems

8.3 Academic Integrity Violations

You agree not to use the Service to:

  • Submit AI-generated content as your own original work in academic settings without proper attribution or when prohibited by your educational institution
  • Generate solutions to academic assignments, exams, or assessments in violation of academic integrity policies
  • Facilitate academic dishonesty or plagiarism

8.4 Immediate Termination Process

ENFORCEMENT: Kampster reserves the right to:

  • Immediately terminate your account without prior notice for any violation of prohibited use
  • Forfeit any subscription fees already paid (refund eligibility subject to our Refund Policy)
  • Block your access to all Service features permanently
  • Report serious violations to appropriate authorities
  • Pursue legal action for damages caused by your violation

Upon termination, you will receive an email notification to your registered email address explaining the reason for termination.

9. SUBSCRIPTION PLANS, COURSE PURCHASES & PRICING

9.1 Available Plans and Purchase Options

Kampster offers the following access options:

  • Free Trial: Limited access to basic features and content to experience the platform
  • Paid Subscription Plans: Various tiers with different features, content access levels, and usage limitations
  • Single Course Purchases: One-time purchases of individual courses for lifetime access to specific course content

9.2 Pricing Information

All pricing information, including subscription plan fees and individual course prices, is displayed within your user account dashboard. Pricing may vary based on:

  • The subscription tier selected
  • Individual course complexity and content depth
  • Promotional offers or discounts available at the time of purchase
  • Currency and geographical location

9.3 Plan and Purchase Management

Users can:

  • Subscribe to any available paid plan
  • Purchase individual courses on a one-time basis
  • Upgrade or downgrade their subscription plan at any time
  • Cancel their subscription at any time (does not affect single course purchases)
  • Manage all subscription and purchase settings through their account settings

9.4 Service Modifications

Kampster reserves the right to introduce new subscription plans, modify existing plans, add or remove courses, or discontinue plans at any time with appropriate notice to affected users.

9.5 Access Limits

Your subscription plan or course purchase may include limitations on:

  • The number of AI tutoring sessions per day or month
  • The depth or complexity of AI-generated content
  • Access to premium courses or specialized learning materials
  • The number of proctored tests you can take
  • Data storage for saved learning progress or custom materials

For single course purchases, access limitations apply only to the specific course purchased and do not include subscription-level benefits unless otherwise stated.

10. PAYMENT TERMS

10.1 Payment Processing

All payments for Kampster subscriptions are processed by our payment processor. Your payment relationship is with our payment processor, and you agree to comply with their terms of service when making payments.

10.2 Billing Cycle

Unless otherwise stated, subscriptions are billed in advance on either a monthly or annual basis, depending on the plan you select. Your subscription will automatically renew at the end of each billing period unless you cancel it prior to the renewal date.

10.3 Payment Methods

You must provide valid and updated payment information when subscribing to the Service. By providing payment information, you represent that you are authorized to use the payment method and agree to allow our payment processor to charge the applicable subscription fees.

10.4 Price Changes

Kampster reserves the right to change subscription fees at any time. Any price changes will apply to billing cycles starting after the date of the price change. We will notify you of any price changes at least 30 days before they take effect.

10.5 Taxes

Subscription fees may not include applicable taxes. You are responsible for paying all taxes associated with your subscription, except where Kampster or our payment processor is legally obligated to pay or collect taxes on your behalf.

10.6 Failed Payments

If your payment fails, your access to the Service may be suspended until valid payment is processed. Multiple failed payments may result in the cancellation of your subscription.

10.7 Currency

All fees are stated in and processed in the currency specified on the Pricing page. Fees charged in a currency other than your local currency may be subject to exchange rate fluctuations and bank fees that are your responsibility.

11. REFUND POLICY

11.1 Refund Policy Reference

Our refund policy is detailed in our Refund Policy, which is incorporated into these Terms by reference. By subscribing to any paid plan, you acknowledge and agree to the terms outlined in our Refund Policy.

11.2 Cancellation Process

You may cancel your subscription at any time through your account settings or by contacting help@kampster.com. Upon cancellation:

  • For monthly subscriptions: Your subscription will remain active until the end of the current billing period
  • For annual subscriptions: Your subscription will remain active until the end of the current annual billing period
  • Refund eligibility is subject to the terms outlined in our Refund Policy

11.3 Effect of Cancellation

Upon cancellation or termination of your subscription, your access to premium features will end at the conclusion of your billing period, and you may lose access to saved content, learning progress, and personalized AI interactions.

12. ACCOUNT MANAGEMENT

12.1 Account Registration

To use certain features of the Service, you must register for an account by providing accurate and complete information as prompted by the registration form. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

12.2 Authentication

We use email-based One-Time Password (OTP) authentication for secure account access. By providing your email address, you consent to receiving OTP codes and other account-related communications.

12.3 Account Security

You agree to:

  • Create a strong, unique password for your Kampster account
  • Keep your login credentials confidential and secure
  • Not share your account with any third party
  • Notify us immediately at help@kampster.com of any unauthorized use of your account or other security breach
  • Ensure you log out from your account at the end of each session when accessing the Service on shared devices

12.4 Account Information

You are responsible for keeping your account information, including email address and payment details, current and accurate. Kampster is not responsible for any issues or losses arising from outdated or incorrect account information.

12.5 Account Closure

You may close your account at any time by following the instructions in your account settings or by contacting help@kampster.com. Upon account closure:

  • You will lose access to all content, including your learning history and saved materials
  • Refund eligibility for any remaining subscription period is subject to our Refund Policy
  • Kampster may retain certain information as required by law or for legitimate business purposes

13. PRIVACY POLICY REFERENCE

13.1 Privacy Policy

Your privacy is important to us. Our Privacy Policy describes how we collect, use, process, and protect your personal data in connection with your use of the Service. The Privacy Policy is incorporated into these Terms by reference.

13.2 Marketing Communications

By creating an account, you consent to receive:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

KAMPSTER DOES NOT WARRANT THAT: (A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

14.2 Comprehensive AI-Specific Disclaimers

IN ADDITION TO THE GENERAL DISCLAIMERS ABOVE, KAMPSTER SPECIFICALLY DISCLAIMS ALL LIABILITY FOR:

  • ANY INACCURACIES, ERRORS, OMISSIONS, OR MISLEADING INFORMATION IN AI-GENERATED CONTENT
  • ANY EDUCATIONAL, PROFESSIONAL, OR PERSONAL CONSEQUENCES RESULTING FROM RELIANCE ON AI-GENERATED CONTENT
  • ANY DAMAGES RESULTING FROM DECISIONS MADE BASED ON AI RECOMMENDATIONS OR SUGGESTIONS
  • ANY WARRANTY REGARDING THE QUALITY, ACCURACY, RELIABILITY, OR SUITABILITY OF AI TUTORING
  • ANY GUARANTEE THAT AI-GENERATED CONTENT IS ORIGINAL, UNIQUE, OR FREE FROM UNINTENTIONAL SIMILARITIES TO EXISTING WORKS
  • ANY WARRANTY THAT AI CONTENT IS SUITABLE FOR YOUR SPECIFIC LEARNING NEEDS, CULTURAL CONTEXT, OR EDUCATIONAL OBJECTIVES
  • ANY HARM RESULTING FROM AI SYSTEM LIMITATIONS, BIASES, OR UNEXPECTED BEHAVIORS

14.3 Maximum Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL KAMPSTER, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
  • DAMAGES RESULTING FROM YOUR RELIANCE ON AI-GENERATED CONTENT
  • DAMAGES RESULTING FROM ANY CONTENT ACCESSED THROUGH THE SERVICE
  • DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT
  • DAMAGES FOR ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE
  • EDUCATIONAL SETBACKS, ACADEMIC FAILURES, OR CAREER DAMAGES
  • PERSONAL, PROFESSIONAL, OR FINANCIAL LOSSES OF ANY KIND

IN ANY CASE, KAMPSTER'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO KAMPSTER FOR THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH LIABILITY, OR S$100, WHICHEVER IS GREATER.

14.4 Exclusions

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. THEREFORE, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

15. MODIFICATIONS TO THE SERVICE

15.1 Service Changes

Kampster reserves the right to modify, suspend, or discontinue any part of the Service, including features, functionality, and content, temporarily or permanently, at any time with or without notice.

15.2 Updates to Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Service, by email, or by other means before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of such changes.

15.3 Pricing Updates

Changes to subscription pricing will be announced at least 30 days in advance. Current subscribers will maintain their existing pricing until the end of their current billing cycle before new rates apply.

We will notify users of significant changes through one or more of the following methods:

  • Email notification to the address associated with your account
  • Prominent notice on the Kampster website
  • In-app notification when you access the Service
  • Direct message to your Kampster account

16. GOVERNING LAW & JURISDICTION

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

16.2 Consumer Rights

If you are a consumer habitually residing in a jurisdiction with mandatory consumer protection laws, you additionally benefit from any mandatory provisions of consumer law of the country where you reside. Nothing in these Terms affects your rights as a consumer to rely on mandatory provisions of local consumer law.

16.3 Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through informal means. You agree to contact Kampster at legal@kampster.com with details of your dispute before filing any formal legal proceedings.

16.4 Jurisdiction

If informal dispute resolution is unsuccessful, all disputes arising from or relating to these Terms or the Service shall be resolved by the competent courts of Singapore, except where prohibited by applicable consumer protection laws.

18. MISCELLANEOUS

18.1 Severability

18.2 Waiver

Kampster's failure to enforce any right or provision of these Terms shall not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by an authorized representative of Kampster.

18.3 Assignment

These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you without our prior written consent, but may be assigned by Kampster without restriction.

18.4 Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or additional terms and conditions published by Kampster, shall constitute the entire agreement between you and Kampster concerning the Service, superseding any prior agreements.

18.5 Section Headings

Section headings in these Terms are for convenience only and have no legal or contractual effect.

18.6 Force Majeure

Kampster will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, civil unrest, government actions, labor disputes, or internet service disruptions.

The provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

By using Kampster, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
